This Consumer Health Data Privacy Policy describes how ActiveFormula LLC (“ActiveFormula,” “we,” “us,” or “our”) collects, uses, and discloses Consumer Health Data in connection with product-support, product-quality, product-safety, allergy, and adverse-event communications. It supplements the ActiveFormula LLC Privacy Policy.

1. Consumer Health Data We Collect and How We Use It

Consumer Health Data may include:

  • health-related details you provide, such as symptoms, allergies, pregnancy, medications, supplement use, dietary concerns, reported reactions, or other health information;
  • product-quality and product-safety details, such as the product involved, order information, lot code, best-by date, photographs, and the circumstances or outcome of a reported issue; and
  • associated identifiers, such as your name, contact information, order number, and account or technical identifiers used to locate and manage the relevant communication or record.

We use Consumer Health Data to:

  • respond to your communication;
  • investigate product-quality, product-safety, allergy, or adverse-event matters;
  • communicate safety notices, recalls, market withdrawals, or other important product information;
  • comply with legal, regulatory, reporting, and recordkeeping obligations;
  • prevent fraud, maintain security, and protect consumers and our business; and
  • establish, exercise, or defend legal claims.

We may create de-identified information in accordance with applicable law and use it for product-quality, product-safety, compliance, and internal trend analysis.

2. Sources of Consumer Health Data

We may collect Consumer Health Data from:

  • you or a person acting at your direction;
  • Shopify and order records used to identify the relevant transaction, subscription, product, or lot; and
  • processors acting for us, such as customer-support, communications, cloud, information-technology, product-quality, product-safety, or regulatory-support providers.

3. Disclosures of Consumer Health Data

When reasonably necessary for the purposes described above, we may disclose Consumer Health Data to:

  • processors and contractors acting under our instructions, including Shopify and customer-support, communications, cloud, information-technology, product-quality, product-safety, or regulatory-support providers;
  • product-quality and product-safety specialists, such as laboratories, technical experts, consultants, or insurers;
  • professional advisers, including legal counsel and auditors;
  • government, regulatory, law-enforcement, judicial, or product-safety authorities when required or permitted by law; and
  • other recipients at your direction or with legally sufficient consent.

Affiliates receiving Consumer Health Data: None.

We do not sell Consumer Health Data or disclose it for targeted advertising.

4. Consent

Where applicable law requires affirmative consent for the collection, use, or sharing of Consumer Health Data, we will obtain the required consent before the processing begins. You may withdraw consent where applicable by using the request method below.

5. Your Consumer Health Data Rights

We may request information reasonably necessary to authenticate your identity and locate the relevant record. We use authentication information only to verify and fulfill the request, maintain security, prevent fraud, and document compliance.

We will respond within the period required by applicable law. If you request deletion, we will notify processors, contractors, affiliates, and other recipients as required by law. Deletion from archived or backup systems may be delayed for the period permitted by law.

If we deny a request and applicable law provides an appeal right, you may appeal by replying to our decision or emailing privacy@activeformula.shop with the subject line Consumer Health Data Appeal.
