This Privacy Policy describes how ActiveFormula LLC (“ActiveFormula,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information in connection with https://www.activeformula.shop (the “Site”), our online store, customer accounts, purchases and subscriptions, emails, advertisements, social-media pages, customer support, reviews, promotions, referral or creator programs, and other interactions with us (collectively, the “Services”).

This Privacy Policy is a notice of our practices. It is not intended to obtain consent where applicable law requires separate affirmative consent.

Shopify or another account provider may process account credentials used to authenticate you. We generally receive account identifiers and status information rather than raw account passwords.

We do not directly receive or store full payment-card numbers or card security codes in our own systems. Shopify Payments and other payment providers collect and process full payment credentials to complete transactions. We generally receive limited payment information, such as card brand, last four digits, payment token, authorization status, and transaction status.

3. Sources of Personal Information

We collect personal information:

  • directly from you, including when you browse or shop, create an account, make a purchase, enroll in or manage a subscription, contact us, submit a review, join a marketing list, enter a promotion, or participate in a referral or creator program;
  • automatically from your browser or device, using cookies, pixels, tags, SDKs, web beacons, local storage, and server logs;
  • from service providers and business partners acting in connection with our Services, including Shopify, payment processors, subscription platforms, fulfillment and shipping providers, communications providers, customer-support providers, review and referral tools, fraud-prevention providers, and analytics or advertising providers;
  • from advertising platforms, which may provide campaign, attribution, audience, or engagement information; and
  • from social-media, referral, creator, affiliate, or promotional partners, when you interact with us or authorize them to provide information to us.

We may combine information from these sources with other information we maintain about you.

4. How We Use Personal Information

We may use personal information to:

  • provide, operate, maintain, and improve the Services;
  • process payments, fulfill orders, manage subscriptions and recurring purchases, arrange shipping, and process returns, refunds, exchanges, cancellations, and chargebacks;
  • create and manage accounts and authenticate users;
  • communicate with you about orders, subscriptions, accounts, product updates, recalls, safety notices, and customer support;
  • investigate product-quality issues, adverse reactions, allergies, damaged or missing products, lot-code or best-by-date concerns, recalls, and market withdrawals;

Where applicable law requires it, our collection, use, retention, and disclosure of personal information will be reasonably necessary and proportionate to the disclosed purposes. We may also process information for purposes compatible with the context in which it was collected, after providing additional notice or obtaining consent where required, or as otherwise permitted by law.

5. Cookies, Analytics, Advertising, and Privacy Choices

We and our service providers or partners use cookies and similar technologies for the following purposes:

  • Essential technologies to operate checkout, accounts, subscriptions, security, fraud prevention, load balancing, and other requested functions.
  • Functional technologies to remember preferences and improve Site functionality.
  • Analytics technologies to understand use of the Site, diagnose issues, attribute traffic or purchases, and measure performance.
  • Advertising technologies to measure campaigns, attribute purchases, retarget visitors, create custom or similar audiences, and show more relevant advertisements on other services.

Depending on the tools enabled, these parties may include Shopify, Google Analytics, Google Ads, Meta, TikTok, email providers, review and subscription providers, and other analytics or advertising providers. Advertising partners may receive identifiers such as cookie IDs, device IDs, IP addresses, advertising identifiers, or hashed email addresses or phone numbers; commercial information; internet activity; approximate location; and related inferences.

We do not sell personal information for money. However, the use of advertising technologies may constitute a sale, sharing, or targeted advertising under applicable law.

We do not provide nonpublic customer-support content, product-safety or adverse-event reports, or details concerning allergies, medications, pregnancy, or symptoms to advertising partners for targeted advertising. General product-view, cart, purchase, and subscription information may be used for advertising where permitted by law and subject to your opt-out rights. If applicable law treats particular information as Consumer Health Data, we will obtain any consent required before using or sharing it for that purpose.

Your Advertising and Cookie Choices

You may use the Your Privacy Choices or Do Not Sell or Share My Personal Information link in the Site footer to opt out of sale, sharing, or targeted advertising and to manage available cookie choices.

Where required by applicable law, we process recognized universal opt-out preference signals, including Global Privacy Control, as a request to opt out of sale, sharing, or targeted advertising for the browser or device that sends the signal and, where we can reasonably associate the signal with an account or profile, for that account or profile as required by law.

Traditional browser “Do Not Track” signals are not uniform. We respond to Global Privacy Control and other universal opt-out signals where required by applicable law.

6. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients.

Service Providers and Contractors

Vendors that process information on our behalf, including ecommerce, hosting, cloud, IT, security, payment, subscription, fulfillment, shipping, customer-support, communications, review, form, referral, fraud-prevention, analytics, and marketing providers. Where required, our contracts restrict these providers to specified purposes and impose appropriate confidentiality, security, deletion, and assistance obligations.

Advertising and Marketing Partners

Advertising networks, analytics providers, social-media platforms, and marketing partners that help us measure campaigns, create or measure audiences, provide targeted advertising, and understand engagement. These disclosures are subject to the privacy choices described in this Privacy Policy and applicable law.

Shopify and Shopify Network Intelligence

Our online store is hosted by Shopify. Shopify processes personal information to provide ecommerce, checkout, payment, account, fraud-prevention, analytics, personalization, and related services to us and to you.

We use Shopify Network Intelligence and Shopify Enhanced Services. Shopify uses information from your interactions with our store together with information from your interactions with other merchants and Shopify to provide enhanced fraud-prevention, analytics, performance, personalization, advertising, and related services. Information submitted through the Services is transmitted to Shopify and may be processed by Shopify and its service providers in the United States and other countries. Shopify is responsible for its independent processing of personal information for these Enhanced Services.

Where required by law, you may opt out of the use of personal information for sharing or targeted advertising through Your Privacy Choices. Choices submitted through that page, a recognized universal opt-out preference signal such as Global Privacy Control, or another tool properly integrated with Shopify’s Customer Privacy API are communicated to Shopify for the applicable processing. You may review the Shopify Consumer Privacy Policy and use the Shopify Privacy Portal to exercise rights available directly through Shopify.

Payment Providers

Shopify Payments and other payment providers collect and process full payment-card details under their own privacy notices. We do not directly receive or store full payment-card numbers or card security codes in our own systems. We generally receive limited payment information, such as card brand, last four digits, payment token, authorization status, and transaction status.

Fulfillment, Shipping, and Logistics Providers

Warehouses, logistics providers, and carriers that process, ship, deliver, track, replace, return, or support orders.

Program and Business Partners

Referral, affiliate, creator, co-promotion, sampling, or giveaway partners when needed to administer a program, provide a benefit, prevent abuse, or as described in program-specific terms or notices.

Affiliates and Professional Advisers

Current or future affiliates and legal counsel, accountants, auditors, insurers, banks, consultants, and other professional advisers for the purposes described in this Privacy Policy.

Legal, Safety, and Compliance Recipients

Courts, law-enforcement agencies, regulators, government authorities, product-safety authorities, or other parties when we reasonably believe disclosure is required or permitted by law, necessary to protect rights or safety, or appropriate in connection with recalls, adverse-event obligations, fraud, disputes, or legal claims.

Corporate Transactions

Potential or actual buyers, investors, lenders, advisers, and other parties in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction.

Other parties when you direct us to disclose information or provide legally sufficient consent.

Public Disclosures

Information you post publicly, including reviews, testimonials, social-media posts, or other user-generated content, may be visible to others. Our right to use submitted content is also governed by our Terms of Service and any program-specific terms.

7. Consumer Health Data

Health-related information included in a product-support, product-quality, product-safety, allergy, or adverse-event communication may be Consumer Health Data under applicable law. We use this information to respond to the communication, investigate the matter, communicate safety information, comply with regulatory, reporting, recordkeeping, and legal obligations, maintain security, and establish, exercise, or defend legal claims.

Additional information about this processing and applicable rights is provided in our Consumer Health Data Privacy Policy. We do not sell Consumer Health Data or use nonpublic health, allergy, medication, pregnancy, symptom, product-safety, or adverse-event details for targeted advertising.

8. Email Marketing

We may send promotional emails where permitted by law and consistent with your marketing preferences. You may unsubscribe through the link in any promotional email. Even after you unsubscribe, we may send non-promotional messages, including order, shipping, account, subscription, safety, recall, policy, and customer-support communications.

9. Promotions, Discounts, and Financial Incentives

We may offer discounts, samples, loyalty or referral benefits, giveaways, or other programs that involve the collection of personal information. Where required by law, we will provide a separate notice describing the program’s material terms, the categories of information involved, how the benefit relates to the information, and how to withdraw. Participation is voluntary.

10. Retention

We retain each category of personal information for periods reasonably appropriate to the purposes described in this Privacy Policy, including to provide the Services, maintain accounts and subscriptions, complete transactions, provide support, maintain product-quality and safety records, comply with tax, accounting, regulatory, and legal obligations, prevent fraud, resolve disputes, enforce agreements, and protect legal rights. We may retain information longer where permitted or required by law or where reasonably needed for security, fraud prevention, disputes, litigation, investigations, or business-continuity purposes.

The category-specific criteria in the Notice at Collection table guide our retention decisions. We may retain a limited record of an opt-out, deletion, or other privacy request to document compliance, and we may retain aggregated or de-identified information that cannot reasonably identify you.

11. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No transmission or storage system is completely secure, and we cannot guarantee absolute security. If you believe your account or interaction with us is no longer secure, contact us promptly.

12. Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 provided personal information to us, contact us so that we can take appropriate action.

We do not knowingly sell or share personal information, or process it for targeted advertising, concerning a minor without any affirmative authorization required by applicable law.

13. United States Only

The Services are intended for consumers in the United States. If you access the Services from outside the United States, information may be transferred to and processed in the United States and other countries where our service providers operate, which may have different privacy laws.

14. Your Privacy Rights

Depending on your state of residence, whether an applicable law covers ActiveFormula, and subject to legal exceptions, you may have the right to:

  • confirm whether we process your personal information and access or obtain a copy of it;
  • learn the categories and specific pieces of personal information we collect, the sources, purposes, and categories of recipients;
  • correct inaccurate personal information;
  • delete personal information;
  • obtain personal information in a portable format;
  • opt out of sale, sharing, targeted advertising, or certain profiling;
  • limit certain uses or disclosures of sensitive personal information;
  • withdraw consent where processing is based on consent;
  • request information about specific third parties to which we disclosed personal information, where applicable;
  • appeal a decision concerning a privacy request, where applicable; and
  • exercise applicable rights without unlawful discrimination or retaliation.

These rights are not absolute. We may deny or limit a request where permitted by law, including when information is needed to complete a transaction, maintain subscription, tax, product-quality, safety, fraud-prevention, or legal records, protect rights, or comply with law.

15. How to Exercise Your Rights

You may submit an access, correction, deletion, portability, or other privacy request by emailing privacy@activeformula.shop or call us at 1-307-218-7834. Please describe the right you wish to exercise and provide information reasonably sufficient for us to identify the relevant records.

For sale, sharing, and targeted-advertising opt-outs, use the Your Privacy Choices or Do Not Sell or Share My Personal Information link in the Site footer. You may also use a recognized universal opt-out preference signal, such as Global Privacy Control, where applicable.

We may need to verify your identity before acting on access, correction, deletion, or portability requests. Depending on the request, we may ask for information such as your name, email address, order number, account information, or other information reasonably necessary to match you to our records. We will use verification information only for verification, security, fraud prevention, and request fulfillment.

Authorized Agents

Where permitted by law, an authorized agent may submit a request for you. We may require proof of the agent’s authority and may ask you to verify your identity or confirm the authorization directly.

California Direct-Marketing Requests

California residents may contact us at privacy@activeformula.shop to request information available under California Civil Code section 1798.83 regarding certain disclosures of personal information to third parties for their own direct-marketing purposes.

16. De-Identified and Aggregated Information

We may create and use aggregated, anonymized, or de-identified information for analytics, forecasting, product and service development, advertising measurement, and other lawful business purposes. Where required by law, we will maintain de-identified information in de-identified form, will not attempt to re-identify it except as permitted to test de-identification processes, and will contractually require recipients to maintain it in de-identified form.

17. Third-Party Services

The Services may link to or integrate with third-party websites, applications, platforms, payment services, social-media services, or other services that we do not control. Their independent privacy practices are governed by their own notices and terms. This Privacy Policy does not apply to their independent processing.
